TOborLife (“or “we”) operates the website www.toborlife.ai (the “Site”), where customers (“Customers”) can buy robotics products (“Products”) sold by TOborLife These terms and conditions (“Conditions”) form a legally binding contract between you (“Customer”) and for using the Site and purchasing Products. 

General Provisions sections of these Conditions. We may update the Site and Conditions at any time without notice, so review them each time you place an order. If you disagree with any of these Conditions, do not use the Site or purchase Products.

All Products sold on the Site are deemed to be of good quality and reliable. However, we advise against using Products in applications where malfunctioning could cause property damage, injury, or death. Users are responsible for the operation and use of robots and robotics technology.

Be cautious and act responsibly.

Website Use

You agree to use the Site only as permitted by these Conditions. You will not access or attempt to access the Site other than through the interface provided unless authorized by a separate written agreement. You will not use automated means to access the Site, such as web scrapers or crawlers, and you will not engage in activities that disrupt the Site’s functionality. You agree not to duplicate, reproduce, copy, distribute, or resell the Site or its content for any purpose. You are responsible for any breach of these Conditions and its consequences.

All information on the Site, including images, descriptions, applications, demonstrations, or programming samples, is provided for instructional purposes and not guaranteed for any specific use. It assumes no responsibility for third-party content on the Site, including infringement of intellectual property rights or any damages from using such content. Links to third-party websites are provided as resources and is not responsible for their content.

Purchase Agreement

By accepting delivery of any Product purchased on the Site from a Vendor, you agree to be bound by the terms below. These terms govern the sales transaction between you and the Vendor selling Products on the Site. Any attempt to modify these terms by you will be null and void. All transactions occur between you and the Vendor (either or a third-party Vendor). For Products purchased from third-party Vendors, the Vendor is the “seller of record,” and acts as the platform provider and marketplace facilitator, not a party to the transaction.

Risk of Loss

The risk of loss and title for items purchased on the Site is passed to you upon receipt.

Cancelling an Order

You can cancel orders that haven’t entered the shipping process by contacting promptly via the Support Center or phone. If the order has already shipped, it can be returned according to the Returns policy. Orders cannot be canceled once processed, and restocking fees of up to 25% may apply for returns. Shipping charges are non-refundable. 

Returns

If unsatisfied with a Product, you may return it for a refund within 30 days of receipt, unless stated otherwise in the Product listing. Contact us for a return authorization (“RA”) number before returning the Product. Returns must be in original packaging, in resalable condition, with the receipt and RA number. Non-compliant returns will not be refunded. Reimbursements, excluding shipping fees, will be processed within 7 to 14 days. You must cover return shipping costs unless the return is due to shipping.

Any opened products subject to 25% restocking charge.

Warranty

The warranty term for purchases is 1 year from purchase unless otherwise stated.

Any physical damage to a Product purchased on the Site, including damage from improper handling or irregular use, will void the manufacturer’s warranty.

Within the first 30 days of receiving a defective Product in the contiguous United States, covers return shipping fees. After this period, customers must cover the cost of returning defective Products to for exchanges or repairs. Shipping costs for sending the new or repaired Product back to the customer are covered within the contiguous United States. International customers are responsible for all shipping costs and duties for exchanges or repairs.

Limitation of Liability

ToborLife’s maximum liability is limited to the purchase price of the Products sold. They are not liable for any claims or damages beyond this limit, including third-party claims, malfunction, delays, service interruptions, loss of business, or special or exemplary damages, even if aware of the possibility of such claims or damages.

Pricing

All prices are listed in U.S. dollars (USD) and do not include taxes or shipping and handling fees. Prices may change without notice due to supplier or manufacturer adjustments and may contain typographical errors. In case of a pricing error, we reserve the right to either honor the incorrect price or suspend the order and inform the customer of the error, offering the option to proceed at the revised price or cancel the order.

Payment Methods

Orders are not binding until accepted and payment is received unless otherwise agreed in writing. Payment is due before shipment unless specified otherwise. For orders including back-ordered products, payment for the entire order is processed at checkout, and the order ships once all items are available. To receive available products immediately, place separate orders.

Credit Card: To pay by credit card, enter your card number and expiry date at checkout. We accept Visa, MasterCard, American Express, Discover, and Diners Club. For secure payment information, refer to the Security & Privacy section. If you prefer not to pay online, contact us by phone at 1-866-627-3178 or fax at 450-420-1447.

We screen all credit card transactions to ensure address and phone number match the credit card account to avoid delays. Most credit card orders are processed and confirmed on the same day. If we need additional information, we will contact you.

Wire Transfer: Pay by bank transfer, with a $20 transaction fee for orders under $1000. Email us at sales@toborlife.ai for wire information.

Purchase Orders: Accepted for educational institutions and government entities with proper documentation. Terms are Net 30 days, and we reserve the right to refuse or cancel any purchase order with an outstanding balance.

Affirm: Available for USA-based customers to pay over time. Application is made at checkout. For details, see Affirm FAQ

We prioritize security. All credit card payments are secured and processed by Authorize.net, certified Level 1 PCI DSS compliant.

Taxes

Sales tax may apply based on the shipping address. For orders outside the U.S., duties, taxes, and customs fees may be charged upon delivery, which you are responsible for. If these fees are not paid, the package will be returned, and any refund will be processed after accounting for shipping, return, and applicable fees.

General Provisions

Governing Law and Jurisdiction

For users outside the USA, any disputes or claims related to your use of the Site, or to any products, will be resolved through binding arbitration, not court, except for qualifying small claims. To initiate arbitration, send a letter describing your claim to sales@toborlife.ai. If we disagree, the matter will be referred to the American Arbitration Association (AAA) under its rules, including the AAA’s Supplementary Procedures for Consumer-Related Disputes. AAA rules are available at www.adr.org or by calling 1-800-778-7879. Filing, administration, and arbitrator fees will be governed by AAA rules. We will reimburse fees for claims under USD 1,000 unless deemed frivolous by the arbitrator. We will not seek attorney’s fees and costs in arbitration unless the claims are deemed frivolous. Arbitration can be conducted by phone, written submissions, or in person at a mutually agreed location.

Dispute resolution proceedings will be on an individual basis, not a class, consolidated, or representative action. If a claim proceeds in court, both parties waive the right to a jury trial. Both parties may bring suits in court for intellectual property rights infringement or misuse.

By using the Site, you agree that the U.S. Federal Arbitration Act, applicable U.S. federal law, and the laws of New York, USA, govern these Conditions of Use and Sale, without regard to conflict of laws principles. The United Nations Convention on Contracts for the International Sale of Goods does not apply to these Conditions.

Severability

If any provision of these Conditions is found invalid, illegal, or unenforceable, the remaining provisions will remain in effect. The invalid provision will be modified to achieve the closest valid result under the applicable USA and the State of California Law, such as it is.

Waiver

Failure by either party to require the performance of any provision does not affect their right to require performance later. A waiver of any breach must be in writing and is not a continuing waiver unless specified.

Entire Agreement

These Conditions, together with Robot Shop’s invoice, constitute the complete agreement between TOborLife and the Customer, superseding all prior proposals, understandings, representations, conditions, warranties, and communications, oral or written, related to the purchase of Products. These Conditions cannot be modified by prior dealings, custom, or usage.

Customer and TOborLife agree that these Conditions are entered into.
